More delays for Galaxy tablet

Samsung faces further delays in releasing its Galaxy Tab 10.1 in Australia after Apple applied for special leave to appeal against a Federal Court decision.

The High Court on Friday granted a one-week stay to allow it to consider whether to accept Apple's application for special leave to appeal against a decision overturning a ban on the sale of the Samsung product.

Last Wednesday, Samsung won its appeal against a ban on the sale of its Galaxy Tab 10.1 in Australia.

The ban had been in place since October, when Apple was granted an injunction preventing the sale of the tab on the grounds it infringed upon Apple's iPad2 touch screen patent.

"Samsung believes Apple has no basis for its application for leave to appeal and will vigorously oppose this (in) the High Court," a statement from Samsung Electronics Australia said on Friday.

A Samsung spokeswoman said the company had been hoping to supply the Galaxy Tab 10.1 before Christmas but it would not know if it could until the application was played out in the High Court.

The Federal Court has previously heard it would take seven days to launch the Galaxy for sale in Australia.

More than 600 stores nationwide had been ready to receive the Galaxy Tabs before they were banned.

The stay has been granted until December 9.
